Illegal immigration and Arizona, part 3


As I wrote in my last post, the Peoria Journal Star’s news story on July 7, 2010, page A2 contains the following statement: “The lawsuit filed in federal court in Phoenix said the law, due to take effect July 29, usurps the federal government’s ‘pre-eminent authority’ under the Constitution to regulate immigration.” I pointed out that there is nothing in the Constitution giving the federal government power to regulate immigrants—illegal or legal—or anyone else exclusively once that are located within a particular State. Each State, in fact, has a historical and a fundamental responsibility to regulate the people within its jurisdiction. That is the very basis of a federal system. The States did not surrender that responsibility to the federal government—not then, not now, not ever unless we stop being a federal system.

The article on the 7th also had this additional quote: “The legal action represents a stern denunciation of the law (the Arizona law—my addition), which the Justice Department declared will ‘cause the detention and harassment of authorized visitors, immigrants and citizens who do not have or carry identification documents’ while ignoring ‘humanitarian concerns’ and harming diplomatic relations.” The article does not define the “humanitarian concerns” so I can not comment on that portion of the quote. I don’t know if the Justice Department defines those humanitarian concerns in its lawsuit.

By federal law, legal immigrants are required to carry identification documents, all citizens, if prudent, carry a driver’s license or other identification if they lack a driver’s license, and authorized visitors, I would think, normally carry identification. The only group mentioned who would not normally carry identification documents would be illegal immigrants who don’t legally possess the required identification. Duh! What’s the problem? They are all here ILLEGALLY and by definition are violating federal law. Now, they are also violating Arizona law. What’s the problem?

Conspicuously missing from the lawsuit, at least in the news article, is any claim that the law is racist as has been shouted about by those opposed to the law. The reason is obvious. Since the law is patterned on the federal law, any attempt by the federal government to label it as racist would be laughed out of court since that would mean the federal law is also racist. Calling it racist may appeal to the Obama administration’s supporters but it would not stand up in a reasonable court of law.

As you no doubt know, some cities and several groups have been calling for and have initiated a boycott of Arizona. In a fit of absolute folly, even an Arizona member of the House of Representatives has called for a boycott. Who do you think a boycott of Arizona would most hurt? If a boycott is successful and people stop spending as much money in Arizona, who are the first people who will be laid off?

As an individual who lived in Arizona for a number of years, I invite everyone to be a counter force to any boycott. Come visit Arizona. Spend your vacations in Arizona. Spend your money in Arizona. Help Arizona stand firm against the evil forces who believe they have the right to dictate Arizona law. That includes the Barack Hussein Obama administration which seems not to grasp the concept of a federal system of government. Perhaps the administration is bound and determined to destroy federalism and replace it with an overpowering national government—total control from Washington D.C.

I heard on the Glen Beck radio show on the 8th of July that a restaurant in Philadelphia, Pennsylvania is holding a fund raiser for the State of Arizona on July 14th from 6-10 PM. It seems that the owner of the restaurant put a sign in his establishment stating: “Please speak English.” Naturally, a city department sued the restaurant. Even though he won in court, the city is now harassing him by increasing their inspections and finding fault with the establishment for no good reason. That was the comment of the owner who was being interviewed by Glen Beck.

The fund raiser is his way of showing support for Arizona in its fight against illegal immigration. If you are in the Philadelphia area on the 14th, join in and raise money to fight this arrogance of power by the Barack Hussein Obama administration. STAND UP for the right of States to regulate within their own boundaries. Tomorrow it might be your State that offends the federal government and Barack Hussein Obama.
