A new decision by the Second Circuit Court of Appeals holds that New York’s state government has the right to ban ‘Choose Life’ license plates on the grounds that such a statement is ‘patently offensive (That’s absurd and the court decision is patently offensive! However, what is even more patently offensive is that this issue is even in the federal court system! It is both a violation of the Constitution and a violation of the sovereignty of States! NO lower federal court has authority over a State. This is clearly a State issue and should be resolved at the State level!—my addition).’

All cases where the State is a party MUST begin in the Supreme Court! That is what original jurisdiction means. Do you really believe that the States would have ratified the Constitution if courts that had not even been created yet could tell them what they could or could not do as sovereign States? Seriously? No way on earth! They had just gained independence! They would not give it away to courts that had not yet been created!—my addition)

The dispute stems from a now-suspended program offered by New York’s Department of Motor Vehicles (DMV) which allowed private organizations to create custom license plates. If drivers purchased the plates, the purchasing price was split between the DMV and the non-profit (It was a money making scheme by the State of New York! Order plates much more expensive that normal! The State gets money and the private organization gets money! Typical of blue States!—my addition).

The Children First Foundation (CFF), an organization promoting adoption as an alternative to abortion, submitted a design for a ‘Choose Life’ license plate, which featured a drawing of two children’s faces in front of a yellow sun.

The proposed plate was rejected, with the DMV citing a policy that allows it to ban ‘patently offensive’ plates in order to prevent incidents of road rage. The “patently offensive” category in U.S. speech is typically related to public obscenity laws, and allows for limitations on things like the public display of pornography or other materials that blatantly violate community standards (For the Left, life is patently offensive unless it is their own, their family [sometimes], and their friends and fellow travelers!—my addition).

Later, during the lawsuit, the DMV claimed it was simply carrying out a general ban on plates concerning politically divisive topics, since government-issued license plates could be perceived as government-sponsored speech (What nonsense!—my addition). However, in the past the DMV has approved pro-union and pro-environmental plates (Of course! To the Left, those would be politically acceptable, non-controversial plates!—my addition).

Judge Rosemary Pooler, a Clinton appointee, agreed with New York’s position in her majority opinion. She took this view even though she also ruled that license plates are private speech subject to First Amendment protections. Despite these protections, however, she said that so many New Yorkers could find a plate advocating an anti-abortion position ‘patently offensive’ that the DMV was justified in suppressing the speech (Since when can speech be censured when it is offensive? That is the type of speech that needs protection! Speech that is not offensive doesn’t need protection! She is a federal judge? Seriously?—my addition).

Pooler also said that simple alternatives existed for drivers who wished to express opposition to abortion.

‘[Drivers] may display a ‘Choose Life’ bumper sticker (So can anyone else who has a specialty plate!—my addition)—or even cover every available square inch of their vehicle with such stickers,’ Pooler wrote. ‘That message will resonate just as loudly as if vehicle displayed a ‘Choose Life’ license plate (Then why ban it? She is also illogical!—my addition). It will merely do so without the perception of State endorsement (So, the State is endorsing unions and environmental lies and that is acceptable but LIFE is not?—my addition).’

The decision overturned the ruling of a lower court from 2011, which held that blocking the plates was an illegal First Amendment violation.

In a strong dissent, Judge Debra Ann Livingston said the court was essentially granting the New York DMV the right to suppress any viewpoints it did not like (Which is what it did!—my addition).

The case has been worming its way through the courts for an exceptionally long time. The original Choose Life plate was rejected in 2002, and CFF’s lawsuit was filed in 2004. Even Friday’s ruling was in response to oral arguments that were first made in 2012. Friday’s ruling may not be the last, either. The Alliance Defending Freedom, a public interest law firm representing CFF, has said it is reviewing its legal options in the wake of the ruling (This is what the Left does! When I was in Illinois, a pro-life issue had started in the mid 1990’s and was finally “decided” in about 2011. I don’t remember the exact year. However, constitutionally neither of the cases should have been in the federal system! They were and are State issues!—my addition).

The decision of the court was clearly a terrible decision. That is not why I posted it. I posted it as another example of our federal courts abusing their authority. The original Roe case should have never been in a federal court. It was and is a State issue. Every pro-life State should pass two laws. The first declaring that life begins at conception which it does! The second making all abortions illegal in the State! Then, they refuse to allow the federal courts to get involved because they do not have jurisdiction! And they do not! It is a State issue as guaranteed by the Tenth Amendment!
