Selling beer and wine in Morton—not a past issue

Tonight’s post deals with the following anonymous comment which is posted exactly as written:

Is it any surprise that they didnt run on the issue of allowing grocery stores to sell beer and wine? Was it even an issue at the time often new political issues come up between elections and its not realistic to expect to present a position on every possible issue that could up during their term of office.

That is exactly my point. As far as I know, it was a non-issue. It has been a non-issue for more than fifty years. For years and years, the community seemed to be more than satisfied with the liquor ordinance as written. They seemed to be satisfied with it enough that less than two years ago it was not an issue, as far as I know, in the last election for members of the Board of Trustees.

As far as I know, there is no burning need for this quick rewriting of the ordinance. And from my experience as a school board member, it is a quick change in a major policy. Although the Board may have been studying it for a year or more, as I’ve written before, the public is not going to react to it until it is actually proposed that the ordinance be changed—that did not occur until July 10th during the State of the Village address.

And yet, it is admitted that neither of the two current grocery stores have asked for the ability to sell beer and wine. In fact, as was pointed out in the discussion on August 18th at the Trustee meeting, Wal-Mart, which was built within the last five years, owned land that was outside of the Village. The land was annexed by the Village and the Village specifically required Wal-Mart, as was stipulated in the liquor ordinance, not to market beer and wine or any other alcoholic beverages and Wal-Mart agreed.

It is possible that the ordinance was advanced so rapidly because Lindy’s was hoping to build in Morton and was not going to do so unless the store could sell beer and wine. However, that has been denied by the mayor and the owners have refused to respond to the direct questions I asked them. In any case, the owners have said that they will not be building in Morton and no one has claimed, that I know of, that any other grocery store is waiting on the horizon to build in Morton if they can sell beer and wine.

Without question, this is an important issue in Morton. The mayor has stated publicly that he knew that there would be opposition to the proposal. The two meetings where the issue was publicly discussed had more attendance than any public Trustee meeting, that I know of, since I moved back to Morton over four years ago. We even had TV coverage from the major networks which is not normal.

So, why the rush? Why not have this be an issue at the next election in April? My guess is, that if they had waited until after the April election to finalize the decision there would be more than the current three incumbents on the ballot. There would be electoral competition and this issue would be a central issue of the election campaign.

And indeed, because the mayor and council has passed these amendments already, it is my hope that this issue will be the central issue at the next election. Hopefully, there will be someone challenging the mayor and at least four candidates for the three Trustee positions. By the way, I consider election challenges to be a positive development so the present decision is not all bad if it does generate competition at the ballot box. I don’t think that was the aim of the four Trustees, however.

Here is a potential problem with the Board of Trustees rush to change the ordinances. Let’s say that I decide to run for the Board of Trustees (and I certain am not saying, at this time, that I am going to do so), and I get elected along with Trustees Hermann and Kaufman who had previously voted against the proposed amendments. Each of us campaigned on the position that if elected we would reverse the previous Board’s position. Furthermore, the mayor is defeated by a candidate who also campaigned to repeal the amendments.

But wait, in the mean time, both grocery stores applied for and received the new grocery store liquor licenses. Both stores remodeled their store to sell beer and wine and cut merchandise in other areas to make room for beer and wine. Both stores are now selling beer and wine.

I and the new mayor both campaigned to repeal the ordinances. I certain would vote to do so since I now have a voter sanctioned mandate. The ordinances are repealed. Both grocery stores spent thousands of dollars in anticipation of selling beer and wine as legally allowed and now because of the repeal of the ordinance, they must return to compliance with the previous liquor ordinance.

Would it not have been better to wait a few more months since there was no compelling reason to pass the changes immediately and get a better idea through an election whether or not the amendments were actually supported by the people rather than cause possibly negative ramifications in the business community? What will businesses looking at Morton with the intent to build here think of such an unsettled governmental environment—where an ordinance is overturned in less than a year after passage? Sometimes, circumspection is the better part of governance.

I, for one, hope that these amendments are the CENTRAL ISSUE in the next two elections. Let the chips fall where they may. The present Board of Trustees has thrown down the gauntlet. The question is, will the opposition rise to the challenge. I hope so!
